Introduction and Acceptance of Terms

Welcome to CupCut, an AI video generator that turns text prompts and uploaded images into short videos from your browser. By accessing or using CupCut (“Service”), you agree to comply with these Terms of Service (“Terms”). If you do not agree, please discontinue use immediately.

Use of the Service

CupCut provides browser-based AI generation, editing, preset automations, task processing, and API endpoints for creative production. You agree to use the Service only for lawful purposes and in accordance with applicable regulations, including intellectual property rules governing the images, videos, prompts, and other content you upload or generate.

AI Models and Service Operation

CupCut currently uses Nano Banana models for supported image-generation and editing workflows, and Veo 3.1 and Seedance 2 models for supported video-generation workflows. Grok Imagine may be used as a fallback for certain video requests when the primary workflow is unavailable. The model used for a request may depend on the selected feature, availability, routing, and service configuration. Model availability and routing may change as we maintain and improve the Service.

References to third-party model or service names identify technology used by the Service and do not imply ownership of those third-party models.

User Accounts and Registration

1. Account Creation: You must provide accurate registration information and keep it current. Workspace owners are responsible for user permissions granted within their organization.

2. Security: Maintain the confidentiality of your login credentials. Email support@cup-cut.pro if you suspect unauthorized access.

3. Eligibility: You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service.

Content and Intellectual Property

• Your Content: You retain ownership of uploaded images, videos, prompts, and outputs. You grant CupCut a limited license to process that content solely to provide the Service, troubleshoot issues, and comply with legal requests.
• Generated Assets: Unless otherwise specified in your plan, you receive a worldwide, royalty-free license to use AI-generated or AI-enhanced outputs for personal or commercial projects, subject to the rights of third parties depicted or referenced in the inputs.
• Our Technology: CupCut software, interfaces, documentation, workflows, and brand assets belong to CupCut or its licensors. Third-party models and services remain the property of their respective owners. You may not copy, reverse engineer, or modify the platform beyond what is explicitly permitted.

Content Standards and Prohibited Categories

CupCut must not be used to request, create, upload, distribute, or promote illegal, harmful, abusive, deceptive, or rights-infringing content. The following categories are expressly prohibited:

1. Pornography and NSFW content, including sexually explicit content, non-consensual intimate imagery, or sexualized depictions of real people.
2. Violence and gore, including graphic violence, content that glorifies serious physical harm, or instructions that facilitate violent wrongdoing.
3. Hate speech, including content that promotes hatred, discrimination, dehumanization, or violence against a protected person or group.
4. Child-unsafe content, including child sexual abuse material (CSAM), grooming, sexualization of minors, or any exploitative or endangering depiction of a minor. We apply zero tolerance to this category.
5. Deepfakes and impersonation, including deceptive or non-consensual depictions of real people, misleading identity impersonation, or content intended to defraud, harass, or damage another person.
6. Copyright or trademark infringement, including unauthorized use or imitation of protected works, brands, characters, logos, likenesses, publicity rights, or other intellectual property.

The following activities are also prohibited:

• Promoting or facilitating terrorism, extremism, mass violence, trafficking, exploitation, or other criminal conduct.
• Generating or spreading fraud, scams, spam, materially deceptive content, or misinformation intended to cause harm.
• Creating content that violates privacy, publicity, intellectual property, or other third-party rights.
• Presenting AI-generated content as authentic human-created or documentary content when doing so would mislead others.
• Submitting jailbreak prompts or attempting to evade, disable, or bypass safety controls, content filters, quotas, rate limits, credits, or payment systems.
• Reverse engineering, extracting, copying, reselling, or redistributing our software or services without authorization or an applicable license.
• Interfering with the security, integrity, availability, or performance of the Service, or using automated scripts to create excessive load or harvest data.
• Using the Service in violation of applicable laws, sanctions, regulations, or legally binding orders.

These standards are a minimum. We may restrict additional content when necessary to comply with applicable law, protect users or third parties, or maintain the safety and integrity of the Service.

Content Moderation and Review

We use a multi-layer content moderation process designed to prevent and address violations of these Terms:

• Automated input review: Prompts, uploads, and generation requests may be evaluated by keyword, pattern, semantic, intent, and provider safety filters before processing.
• Automated output review: Generated images and videos may be evaluated by built-in or provider-operated safety and NSFW detection systems. Content may be blocked, withheld, or removed when a safety system identifies a potential violation.
• Usage-pattern monitoring: We may review generation failures, repeated blocked requests, unusual account activity, and other signals of attempted abuse.
• Human review: Content or accounts flagged by automated systems or reported by users may be reviewed manually. We may consider the content, prompt, context, account history, and applicable law when making a decision.
• Periodic review: We may sample activity, assess filter performance, and update our rules and safety controls as risks, technologies, and legal requirements change.

No moderation system is perfect. Users remain responsible for their prompts, uploads, generated content, and use or distribution of any output.

Reporting Violations and Appeals

If you encounter content or activity that may violate these Terms, email support@cup-cut.pro. Include the relevant URL or generation identifier, a description of the concern, and any supporting information that can help us investigate. Do not redistribute illegal imagery; provide only the information needed to identify it.

We review reports based on their nature, severity, available evidence, and potential risk. Urgent child-safety, credible-threat, or other serious illegal-content reports are prioritized. Where appropriate, we may preserve relevant records and cooperate with payment partners, service providers, rights holders, or lawful authorities.

If you believe an enforcement decision was made in error, you may appeal by emailing support@cup-cut.pro. Include your account information, the relevant decision or content identifier, and the reason for your appeal. Appeals do not guarantee reversal of a decision.

Enforcement Actions

We may take one or more of the following actions based on the severity, frequency, context, and legal implications of a violation:

1. Warning: Provide written notice and require the user to stop, edit, or remove the violating activity.
2. Content blocking or removal: Reject a prompt, withhold an output, or remove content that violates these Terms.
3. Feature restriction: Reduce generation quotas or restrict access to particular models, tools, downloads, API endpoints, or other features.
4. Temporary suspension: Suspend an account or access to the Service while a matter is reviewed or remediated.
5. Permanent termination: Permanently close an account for critical, repeated, deliberate, or unresolved violations.
6. Legal or safety referral: Preserve records, report conduct to appropriate authorities or relevant organizations, and cooperate with a lawful investigation when required or reasonably necessary.

We may act immediately and without prior warning for critical violations, including CSAM, credible threats, terrorism, non-consensual intimate imagery, serious fraud, or attempts to evade safety controls. Less severe first-time violations may receive a warning, while repeated violations may result in progressively stronger restrictions. Enforcement under this section is in addition to any other rights or remedies available to us.

Privacy and Data Collection

Our Privacy Policy outlines how we collect and process data. By using the Service, you consent to that policy, including the transfer of information to the United States or other countries where we or our subprocessors operate.

Pricing, Billing, and Refunds

• Plans, credit packs, and API usage are billed through Stripe or approved resellers.
• Subscriptions renew automatically unless cancelled before the renewal date.
• Fees are non-refundable except where required by law or stated otherwise in writing.
• We may change pricing with at least 30 days’ notice. Continued use after the effective date constitutes acceptance.

Termination

We may suspend or terminate accounts that violate these Terms, pose security risks, or fail to pay outstanding invoices. Upon termination:

• Access to the Service is revoked.
• Stored projects may be deleted after 30 days.
• Outstanding fees remain payable.

You may cancel anytime via the billing portal; service remains available until the end of the paid period.

Disclaimer of Warranties

The Service is provided “as is” and “as available.” We do not guarantee uninterrupted availability, error-free operation, or that outputs will meet your expectations. Editing results depend on user-provided inputs and instructions.

Limitation of Liability

To the fullest extent permitted by law, CupCut and its affiliates will not be liable for indirect, incidental, or consequential damages, loss of profits, or loss of data arising from use of the Service. Aggregate liability will not exceed the fees paid to us during the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless CupCut, its officers, employees, and partners from any claims, damages, or expenses arising out of:

• Content you upload, generate, or edit.
• Violation of these Terms or applicable laws.
• Disputes between you and third parties related to your use of the Service.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-law principles. Disputes will be resolved through binding arbitration in San Francisco, California, unless prohibited by local law, in which case the competent courts of Delaware will have jurisdiction.

Changes to These Terms

We may revise these Terms to reflect product updates or legal requirements. Material changes will be communicated via email or in-product notices. Continued use after changes take effect constitutes acceptance.

Service Availability

We aim for 99.5% uptime but may schedule maintenance, deploy updates, or experience outages. Major service notices may be displayed within the Service.
